The provisions relating to the protection of cross-border investors and facilitating the settlement of investments disputes are set out in Chapter 14 of the USMCA (previously set out in Chapter 11 of NAFTA). With the exception of legacy Chapter 11 claims, the investment arbitration provisions set out in Chapter 14 of the USMCA do not apply to Canada. Canadian investors in Mexico and Mexican investors in Canada have access to the ISDS as contracting parties to the Comprehensive and Progressive Agreement for Trans-Pacific Partnership.
